Terms and Condition

1. Introduction and Acceptance of Terms

Welcome to Banigig (“Banigig”, “we”, “us”, or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you and Banigig International Ltd. (including its subsidiaries and affiliates, such as Banigig Inc.).

By accessing or using the website www.banigig.com, our mobile applications, APIs, or any related services (collectively, the “Platform”), you agree to be bound by these Terms, our Privacy Policy, and our Community Standards.


IMPORTANT: If you do not agree to these Terms, you are strictly prohibited from using the Platform and must discontinue use immediately.


2. Seller Obligations & Standards

2.1 Service Delivery

Sellers must deliver the work product in the file formats and quality levels specified in their Gig description. Failure to meet the "Scope of Work" defined at the time of purchase is grounds for a dispute and potential account suspension.

2.2 Exclusivity of the Platform (Non-Circumvention)

To protect the integrity of the marketplace, Users are strictly prohibited from:

  • Sharing personal contact information (Email, Skype, Phone Number, etc.) in the Platform’s messaging system or Gig descriptions to move transactions off-platform.
  • Soliciting or accepting payments outside of the Banigig payment system.
  • Penalty: Any attempt to circumvent Banigig’s fees by transacting externally will result in the immediate and permanent termination of all involved accounts.

2.3 Seller Levels and Performance

Banigig may implement a "Seller Level" system (e.g., Level 1, Level 2, Top-Rated). These levels are determined by automated systems and manual reviews based on:

  • On-time delivery rates.
  • Order completion rates.
  • User ratings and reviews.
  • Adherence to Community Standards.


3. Financial Terms & Withdrawals

3.1 Revenue Clearance

Once an order is completed and marked as "Approved" by the Buyer, the funds are credited to the Seller's account. However, these funds are subject to a clearing period (typically 7–14 days) to allow for financial processing and to protect against chargebacks or fraud.

3.2 Withdrawal Methods

Sellers may withdraw cleared funds using the supported methods provided on the Platform (e.g., PayPal, Bank Transfer, Payoneer). Banigig reserves the right to set minimum withdrawal amounts and may charge administrative fees for certain withdrawal types.

3.3 Chargebacks and Payment Reversals

If a Buyer initiates a chargeback or payment reversal through their credit card provider or bank:

  • The funds will be frozen or deducted from the Seller's balance.
  • Banigig reserves the right to dispute the chargeback on behalf of the Seller using the work evidence provided on the Platform.
  • Abuse of chargeback systems by Buyers will result in a permanent ban.


4. User-Generated Content & Conduct

4.1 Content Guidelines

You may not upload content that:

  • Contains nudity, hate speech, or defamatory material.
  • Promotes "get rich quick" schemes or academic dishonesty (e.g., writing essays for students).
  • Infringes on the Intellectual Property (IP) of any third party.

4.2 Feedback and Reviews

Reviews are a core part of the Banigig ecosystem. You agree not to:

  • Manipulate reviews through "sock-puppet" accounts.
  • Threaten a Seller with a negative review to gain extra services ("Feedback Extortion").
  • Offer incentives (money, freebies) in exchange for positive reviews.


5. Indemnification

You agree to indemnify, defend, and hold harmless Banigig, its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of:

  1. Your access to or use of the Platform.
  2. Your violation of these Terms.
  3. Any work product you deliver as a Seller or any project you post as a Buyer.
  4. Your infringement of any third-party intellectual property or privacy rights.


6. Modifications to the Platform

Banigig is constantly evolving. We reserve the right to:

  • Modify or discontinue any part of the Platform at any time.
  • Update our service fees with prior notice to the community.
  • Change the criteria for Seller Levels or search ranking algorithms without disclosing the specific proprietary logic.


7. Dispute Resolution & Arbitration

7.1 Mediation

Before filing any formal legal claim, you agree to attempt to resolve the dispute informally by contacting [email protected].

7.2 Binding Arbitration

If a dispute cannot be resolved informally, it shall be settled by binding arbitration in the jurisdiction of Banigig’s registration. You waive your right to participate in a class-action lawsuit or class-wide arbitration.


8. General Provisions

  • Severability: If any part of these Terms is found to be unenforceable, the remainder remains in full effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Entire Agreement: These Terms (and the linked Privacy Policy) constitute the entire agreement between you and Banigig.

9. Proprietary Rights and Licenses

9.1 Banigig’s Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Banigig or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. You may not use our trademarks or trade dress in connection with any product or service that is not ours without express written permission.

9.2 License to Use the Platform

Subject to your compliance with these Terms, Banigig grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Platform. This license does not include:

  • Any resale or commercial use of the Platform or its contents.
  • Any collection and use of any product listings, descriptions, or prices.
  • Any derivative use of the Platform or its contents.
  • Any use of data mining, robots, or similar data gathering and extraction tools.

10. Digital Millennium Copyright Act (DMCA) & IP Protection

Banigig respects the intellectual property rights of others. We respond to notices of alleged copyright infringement according to the process set out in the U.S. Digital Millennium Copyright Act and similar global laws.

10.1 Reporting Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with a "Notice of Infringement" containing:

  1. A physical or electronic signature of the owner.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing.
  4. Your contact information (address, telephone number, and email).
  5. A statement of "good faith belief" that the use is not authorized.

10.2 Counter-Notice

Sellers whose content is removed may submit a counter-notice if they believe the removal was a mistake. Banigig reserves the right to terminate the accounts of "repeat infringers."


11. Confidentiality

11.1 User-to-User Confidentiality

Sellers recognize that Buyers may share "Confidential Information" (e.g., trade secrets, business plans, private data) to facilitate the completion of an order. Sellers agree to:

  • Keep all Confidential Information in strict confidence.
  • Not disclose the information to any third party.
  • Use the information solely for the purpose of completing the specific order. Upon completion of the Gig, Sellers shall delete any sensitive data provided by the Buyer unless otherwise agreed.


12. Limitation of Warranty

THE PLATFORM IS PROVIDED "AS IS." Banigig makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, materials, or products included on the Platform. To the full extent permissible by applicable law, Banigig disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Banigig does not warrant that the Platform, its servers, or email sent from Banigig are free of viruses or other harmful components.


13. Sanctions and Export Control

You represent and warrant that you are not:

  1. Located in a country that is subject to a U.S. Government or EU embargo, or that has been designated as a “terrorist supporting” country.
  2. Listed on any government list of prohibited or restricted parties. Any use of the Platform in violation of export control laws is strictly prohibited.


14. Force Majeure

Banigig shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor, or materials, or failures of the internet.


15. Electronic Communications

When you use the Platform or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Platform. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.


16. Right to Audit

Banigig reserves the right to review and audit any and all messages, Gigs, and files exchanged on the Platform for the purpose of ensuring compliance with these Terms, preventing fraud, and conducting risk assessments. This includes the right to use automated tools to scan for off-platform contact information.


17. Glossary of Key Terms

To ensure total clarity, the following definitions apply across the Platform:

  • "Gig": A specific service offered by a Seller on the Platform.
  • "Order": The formal agreement between a Buyer and Seller after a purchase is made.
  • "Custom Offer": A tailored proposal sent by a Seller to a Buyer in response to specific requirements.
  • "Revenue": The money Sellers earn from completed orders, prior to the deduction of service fees.
  • "Milestone": A partial delivery within a large project that triggers a partial payment.
  • "Source Files": The raw, editable files used to create the final delivery (e.g., .PSD, .AI, .DOCX).


18. Specific Service Category Rules

Certain categories on Banigig carry additional responsibilities. By using these categories, you agree to the following:

18.1 Artificial Intelligence (AI) Services

  • Disclosure: Sellers must disclose in their Gig description if AI tools (e.g., ChatGPT, Midjourney) are used to generate the work.
  • Rights: Sellers must ensure they have the commercial rights to any AI-generated output they deliver to a Buyer.

18.2 Voiceovers and Deepfakes

  • Sellers may not provide voiceovers that mimic a real person (celebrity or private citizen) without express written consent.
  • Voiceovers may not be used for "Deepfake" technology or any purpose intended to deceive, defame, or harass.

18.3 Software and Programming

  • Sellers must ensure that any code delivered is free of malicious scripts or backdoors.
  • If open-source libraries are used, the Seller must disclose the license type (e.g., MIT, GNU) to ensure the Buyer is in compliance.


19. Platform Integrity & System Security

19.1 Anti-Phishing & Fraud

Banigig will never ask for your password via email or message. You are responsible for any activity that occurs under your account. If you suspect a security breach, you must notify [email protected] immediately.

19.2 Prohibition of Scraping

You may not use any automated system, including "robots," "spiders," or "offline readers," to access the Platform in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.

19.3 Account Transferability

Accounts are non-transferable. You may not sell, trade, or gift your Banigig account, Seller level, or reviews to another individual.


20. Refund Policy & Credits

20.1 Refund Eligibility

Refunds are typically only issued to the original payment method if the order is cancelled before completion. Once an order is marked "Complete," funds are moved to the Seller's clearing phase and are generally non-refundable.

20.2 Banigig Credits

In some cases, Banigig may issue "Platform Credits" instead of a cash refund. Credits are non-transferable, have no cash value, and may expire after 12 months unless otherwise stated.


21. Modifications to the Agreement

Banigig reserves the right to modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of the page.

  • Significant Changes: For material changes that affect your rights, we will provide 15 days' notice via email or platform notification.
  • Acceptance: Your continued use of the Platform after the notice period constitutes your acceptance of the revised Terms.


22. Survival

Sections regarding Intellectual Property, Confidentiality, Indemnification, Limitation of Liability, and Dispute Resolution shall survive the termination or expiration of these Terms.


23. Language and Interpretation

While these Terms may be translated into other languages for convenience, the English version is the only legally binding version. Any "friendly" summaries provided in the UI are for information only and do not replace the legal text.
